One of the most important problems of public procurement is the effectiveness of funds expenditure. This is why the contracting authority should analyse its needs well before commencing the procedure.

The legislators, who in the Public Procurement Law that has been in effect for nearly a year now, have obliged the contracting authorities to conduct an analysis of needs and requirements, taking into account the type and value of the contract.

Moreover, the analysis should consider the possibilities of satisfying the identified needs using own resources; market research (especially in terms of alternative means of satisfying the identified needs and possible contract execution variants) or the indicative contract value for each of the selected variants.

Compared with the previous legal status, the analysis indicated here is a novelty, but its reliable preparation is a chance for good preparation of the procedure, and thus for increasing the effectiveness of spending public funds.
